TERMS AND CONDITIONS

1. Introduction
These Terms and Conditions ("Terms") govern the use of the Zingato platform, including its mobile application and website (collectively referred to as the "Platform"), operated by Badabajar IT Solution, having its office at Nohsa, Phulwari Sharif, Patna, Bihar. By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Platform immediately.
2. Definitions
In these Terms, the following words shall have the meanings assigned to them below:
- "Platform" means the Zingato mobile application, website (www.zingato.in), and any related services operated by Badabajar IT Solution.
- "User" or "Customer" means any individual who accesses the Platform to browse, place, or receive orders.
- "Vendor" or "Merchant Partner" means any business or individual registered on the Platform to list and sell products or services.
- "Delivery Partner" means any individual engaged by or through Zingato to deliver orders to Users.
- "Order" means a confirmed request placed by a User to purchase goods or services from a Vendor through the Platform.
- "Company" means Badabajar IT Solution, the developer and operator of the Zingato Platform.
3. Eligibility
To use the Platform, you must be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. By using the Platform, you represent and warrant that you meet these eligibility requirements. The Company reserves the right to terminate any account found to have been created by or on behalf of a minor.
4. Account Registration
Certain features of the Platform require you to register an account. You agree to provide accurate, complete, and current information during registration and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify the Company immediately at support@zingato.in upon becoming aware of any unauthorized use of your account.
5. Service Areas
Zingato currently provides delivery services in the following areas in Bihar, India:
- Patna
- Gopalganj
- Siwan
- Mirganj
The Company may expand or modify service areas at its sole discretion and will communicate updates through the Platform.
6. User Responsibilities
As a User of the Platform, you agree to:
- Provide accurate and complete delivery address and contact details at the time of placing an order.
- Be available and reachable at the delivery location during the expected delivery window.
- Use the Platform only for lawful purposes and in a manner consistent with applicable Indian law.
- Refrain from placing fraudulent orders, misusing promotional offers, abusing the Cash on Delivery (COD) facility, or engaging in any activity that disrupts the functioning of the Platform.
- Refrain from impersonating any person or entity, or falsely representing your affiliation with any person or entity.
The Company reserves the right to temporarily suspend or permanently terminate any account found to be in violation of the above obligations, without prior notice.
7. Vendor Responsibilities
Vendors registered on the Platform agree to:
- Maintain the accuracy of their product or menu listings, including descriptions, images, pricing, and availability.
- Ensure that all products sold through the Platform meet applicable quality and hygiene standards, including those prescribed under the Food Safety and Standards Act, 2006 (where applicable).
- Prepare and dispatch orders within the timeframe agreed upon at the time of registration.
- Comply with all applicable laws, rules, and regulations, including tax laws, food safety regulations, and consumer protection laws.
- Promptly communicate any changes in product availability or service disruptions to the Company.
The Company reserves the right to suspend or remove any Vendor from the Platform for non-compliance with these obligations.
8. Delivery Policy
Delivery timelines displayed on the Platform are estimates only and are subject to change based on factors including traffic conditions, weather, distance, and order volume. The Company does not guarantee delivery within any specific timeframe.
If a User is unavailable or unreachable at the time of delivery, the Delivery Partner may attempt redelivery, subject to applicable charges. Unclaimed orders may be treated as cancelled in accordance with the Cancellation Policy set out below.
The Company shall not be liable for delays or non-delivery caused by circumstances beyond its reasonable control, including natural disasters, civil unrest, curfews, or government orders (force majeure events).
9. Vendor Subscription Plans
Vendors may access the Platform under the following subscription plans:
- 1 Month — Rs. 999 (up to 60 orders)
- 1 Month — Rs. 1,999 (unlimited orders)
- 3 Months — Rs. 2,499 (up to 180 orders)
- 3 Months — Rs. 4,999 (unlimited orders)
A 7-day free trial is available for new Vendors, which includes item listing, dashboard access, and customer support. All subscription fees are non-refundable once the trial period has concluded, except where required by applicable law. The Company reserves the right to revise subscription plans upon notice to existing Vendors.
10. Payments
The Platform accepts the following payment methods: Unified Payments Interface (UPI), debit and credit cards, digital wallets, and Cash on Delivery (COD). All online payments are processed through third-party payment gateways that are compliant with applicable security standards. The Company does not store any card numbers, UPI credentials, or other sensitive payment information on its servers.
Prices displayed on the Platform are inclusive of applicable taxes unless stated otherwise. The Company reserves the right to update pricing at any time without prior notice.
11. Refund Policy
Refunds shall be considered in the following circumstances:
- The ordered item was not delivered to the User.
- The order was cancelled by the Vendor prior to dispatch.
- A payment transaction failed but the User’s account was debited.
Refund requests must be raised through the Platform or via support@zingato.in within 24 hours of the scheduled delivery time. Approved refunds will be credited to the original payment method within 2 to 7 business days. Refunds are subject to verification and the Company’s discretion. Partial refunds may be issued in cases of partial delivery or agreed-upon deductions.
12. Cancellation Policy
A User may cancel an order at no charge provided the cancellation is made before the order has been accepted and dispatched by the Vendor. Once an order has been dispatched, cancellation shall not be permitted and no refund shall be issued.
The Company reserves the right to cancel any order at its sole discretion in the event of suspected fraud, unavailability of the ordered item, inability to deliver to the specified location, or any violation of these Terms. In such cases, a full refund will be processed.
13. Intellectual Property
All content on the Platform, including but not limited to logos, trade names, trademarks, application design, graphics, text, and software, is the exclusive intellectual property of Zingato and Badabajar IT Solution. Nothing in these Terms grants you any right, licence, or interest in such intellectual property. Any unauthorised reproduction, distribution, modification, or commercial use of the Platform’s content is strictly prohibited and may attract civil and criminal liability under the Copyright Act, 1957 and the Trade Marks Act, 1999.
14. Limitation of Liability
To the fullest extent permitted by applicable law, the Company shall not be liable for:
- The quality, safety, or fitness for purpose of any product sold by a Vendor through the Platform.
- Any illness, injury, or loss caused by consumption of food or use of products purchased through the Platform.
- Delays, non-delivery, or damage caused by force majeure events.
- Any indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, the Platform.
The Company’s total liability to any User in connection with any dispute arising from these Terms shall not exceed the value of the specific order in question.
15. Grievance Redressal
In compliance with the Consumer Protection Act, 2019 and the Information Technology Act, 2000, the Company has designated a Grievance Officer to address complaints and concerns raised by Users:

All grievances will be acknowledged within 48 hours and resolved within 30 days of receipt. If a dispute is not resolved to your satisfaction, you may approach the appropriate consumer forum under the Consumer Protection Act, 2019.
16. Amendments to These Terms
The Company reserves the right to amend these Terms at any time. Users will be notified of material changes through an in-app notification or by email. Continued use of the Platform following the effective date of any amendment constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts situated in Patna, Bihar, India.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.
By using the Zingato Platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
